Report on Cincinnati Meeting with Rev. Jackson

I attended the breakfast with Jesse Jackson this morning, along with Betty Edmondson who testified at the last hearing. Also attending the meeting were Bill Woods of Common Cause, and John Burik of CASE. UC Professor at CCM Electronic Media Dept and minister Robin Riley. Evan Davis from Pacifica was taping the audio. Silbey Arnebeck, Cliff's lovely wife sat at our table. It was nice seeing a few of the OHio Vote 2004 members there as well.  Cliff Arnebeck gave a great speech about counting the votes and talked about the lawsuits that he and Jesse were filing on behalf of the plaintiffs in Ohio I will leave you with a portion of what Jesse said that I found remarkable.
We can afford to lose our election; but we cannot afford to lose our vote. Jesse Jackson. Hope to see you at the Meeting/Hearing on Wednesday. Juliet Stewart

Jesse Jackson In Tri-state; Calls For Investigation Of Ohio Election
Reported by: Bill Price

Veteran civil rights leader Jesse Jackson was in Bond Hill Monday morning urging Tri-state supporters to join him in challenging this month's vote in Ohio.
His group, the Rainbow PUSH coalition, is calling for a constitutional amendment to standardize elections nationwide, in addition to asking for an independent investigation into Ohio voting. 9News Reporter Bill price says local supporters gave Reverend Jackson a warm reception to challenging the vote in court. Reverend Jesse Jackson was treated as a "celebrity" by almost a hundred ministers and political supporters who joined him for a breakfast reception at Integrity Hall. He repeated his call for an investigation into what he says were "strange goings-on" at some Ohio polls. "Warren County, where they had a homeland security alert... Can you imagine a homeland security alert in Warren? Where there are no buildings higher than 3 stories." said Jackson to a laughing crowd. Jackson also questioned why as many as 1-in-5 provisional ballots in hamilton county were not counted. He says voting rules need to be standardized with a constitutional amendment. "We want an amendment to the constitution. Everyone-- all Americans-- should have the individual constitutional right to vote and have federal protection for that vote. Right now, we have no protection of our right to vote as Americans," said Jackson. The reverend made it clear that he wants to build on the voting rights issue here in Ohio. He asked supporters in Cincinnati to organize and join new chapters of the group he already leads -- the Rainbow PUSH Coalition. Jackson says the voting lawsuits his Rainbow PUSH is organizing, should motivate new voters. "No, I think lawsuits will spread hope. It will say to people, this vote was not in vain. It will stay this struggle to make this a more perfect union is not a one-round fight... it's a long distance journey," said Jackson. How those voting rights challenges proceed may determine whether any new Rainbow PUSH group becomes a viable political force in Ohio, and whether Reverend Jackson gains more stature as a national political leader. Jackson was also involved in Florida protests when voting problems there held up the presidential election for over a month. The reverend is planning another trip to Columbus on Saturday for a voting rights rally there

Green Party Presidential Candidate Seeks Federal Court Jurisdiction in New Ohio Recount Case

COBB/LaMARCHE 2004 http://www.votecobb.org
For immediate release: November 30, 2004
Contact: Blair Bobier, Media Director at 541.929.5755

GREEN PARTY PRESIDENTIAL CANDIDATE SEEKS FEDERAL COURT JURISDICTION IN NEW OHIO RECOUNT CASE

11/30 -- Attorneys for Green Party presidential candidate David Cobb asked a federal court today to take jurisdiction of, and ultimately dissolve, a temporary restraining order issued by a Delaware County, Ohio judge attempting to prevent Cobb from seeking a recount of the presidential ballots cast in that county.

Cobb and Libertarian Michael Badnarik, who are jointly filing the recount demand, are named as defendants, along with their attorneys, in the restraining order sought by the Delaware County prosecuting attorney.

The Delaware County judge issued the temporary restraining order without contacting or seeking any input from the candidates or their attorneys.

"This is an illegal and outrageous attempt to suppress our
rights to participate in the democratic process. As a candidate, I have a right under Ohio law to demand a recount. If the Delaware County Board of Elections has a problem with that, they need to take it up with the Ohio legislature," said David Cobb.

"It makes you wonder if Delaware County has something to hide. Why else would they try to prevent a recount and issue an injunction without giving the candidates any notice to participate?" asked Cobb-LaMarche Media Director Blair Bobier.

Cobb and Badnarik initiated the recount demand on November 19 by sending letters and the appropriate bond to each of the election directors of Ohio's 88 counties, requesting a hand count of the votes in every precinct in every county in the state. The total cost of the bond, based on the number of precincts in which a recount is demanded, is $113,600.

Support for a recount in Ohio is growing on a daily basis. On
Sunday, the Reverend Jesse Jackson held a press conference and rally at a Columbus church and announced his support.

The Cobb-LaMarche campaign is now in the process of recruiting volunteers and raising funds for monitoring the actual recount process. Volunteers and donors should visit the campaign website, http://www.votecobb.org, for more information. Information about the Green Party can be found at http://www.gp.org.

"Election 2004" web site

I haven't used this blog so far to post a review. But the "Election 2004" web site is so extraordinary, I have to mention it.

The link is
http://shadowbox.i8.com/stolen.htm. Copy it, paste it, use it, and BOOKMARK it. Also, tell your friends about it, even Republican skeptics who have the slightest doubt that a coup d'etat, rather than an election, is what is going on.

If you are looking for DETAILED FACTUAL information about the 2004 voter fraud, this web site should be your very first stop. It contains a wealth of valuable information, and links to other valuable information.

As one of the dozens or hundreds of examples to which I could point you, take a look at the recently posted analysis of the systematic minority voter disenfranchisement in Cuyahoga County:

UA Citizens for Change Report on Ohio Actions

UA Citizens for Change UpdateGrassroots democracy at its best!
No. 1 * November 29, 2004
http://www.uacitizensforchange.com/ * E-mail: UAforKerry04@aol.com

We're Back! It's been nearly a month since the UA for Kerry leadership has communicated with our wonderful and committed supporters through our online newsletter, and we apologize for leaving you to cope with the election results on your own. Quite frankly, the wind was knocked out of our sails and it's taken us this long to regroup, recover, recharge -- and refocus. We plan on continuing the group, not as UA for Kerry, but as UA Citizens for Change -- our legal name since August. You will see our name frequently abbreviated as UACC. Shortly we will be changing our e-mail address. We are developing our platform of issues, and brainstorming ideas and directions we want to pursue as a group. We will begin meeting again in January on a monthly basis. We welcome your ideas, and want to know what issues you consider the most important in the coming months. We plan to develop standing committees to provide the larger UACC community with a greater chance for participation, as well as better information and oversight on various concerns such as women's and children's issues; education; the media; and the environment, just to name a few. We are excited about the prospect of being a multi--issue and multi-candidate political action committee.Read this section now!
One issue that is front and center is a push for fair, transparent and accurate elections for this past presidential election and for all future elections. All citizens must have equal access to voting and the electoral process in order to ensure our democracy.

The backstory: America's election system is badly flawed. So flawed, that a Cal Tech/MIT study of the 2000 Election discovered that as many as one in 18 citizens was disenfranchised due to procedural and/or technological anomalies. The 2004 election was no different! Within hours after the final votes were cast on November 2nd, it became apparent that there were too many irregularities nationwide to ignore. Election officials are saying there are things that go wrong in every election, but how will the situation improve if we are content with mistakes? We can make a difference in safeguarding the electoral process by examining the mistakes that occurred in this past election and helping implement change for future elections.

A few irregularities in Ohio that need more investigation:
Many polling places (mostly in urban areas or places close to colleges and universities with typically Democrat voters) were allegedly given fewer voting machines than suburban areas, even fewer machines than what they had during the primary, causing the record numbers of voters in those areas to wait in long lines (typically three to five hours, and in one case, 13 hours) or get discouraged and leave without voting. http://www.freepress.org/columns/display/3/2004/995
In Warren County, election officials locked the doors to the County building and refused to allow bipartisan observers to watch the vote count. They also denied access to an AP reporter (it is standard procedure for the AP to observe vote-counting in counties all over the country).
http://www.enquirer.com/editions/2004/
11/05/loc_warrenvote05.html

In Gahanna, nearly 4,000 votes were cast for Bush in a precinct with roughly 700 voters. http://www.cnn.com/2004/ALLPOLITICS/11/05/voting.problems.ap/
In Perry County, it was discovered that several precincts had nearly 100 more ballots counted than people that cast ballots. Investigations in other precincts and counties were underway to determine if similar types of fraud had been committed when public records became unavailable. http://www.commondreams.org/views04/1118-30.htm
Other anomalies: double counting in Madison and Sandusky counties; machine misvotes for unintended candidates; confusion about provisional ballots; lost voter registrations; and late or no absentee ballots. Visit http://www.votersunite.org/electionproblems.asp to see a list of additional voting anomalies in Ohio and other states. To hear sworn testimony of concerned citizens from one of four public hearings held throughout the state click on http://www.theneighborhoodnetwork.org/.

Several members of the UACC executive committee have been involved since last spring with CASE, an acronym for Citizen's Alliance for Secure Elections, successfully working to keep lawmakers from purchasing electronic voting machines with no paper audit that could be used in a recount. You can get more information at their website: http://www.caseohio.org/.

As can be seen by the voting irregularities in Ohio, this year's election in Ohio was deeply flawed. There are many areas, beyond electronic voting, in need of reform. To that end, CASE is sponsoring a "Fight for Democracy, Investigate All 88 Rally," an initiative to draw attention to problems in our electoral system and to support the Congressional probe of allegations into voting irregularities in Ohio and elsewhere.(See flier copied below.) Thousands of people are needed to attend the rally to show Ohio election officials, lawmakers and the nation that we believe every voter counts and every vote must be counted, and that election systems need to be corrected to insure that our most precious right as citizens -- choosing our leaders through a tamper-free, transparent, verifiable voting process -- is developed and protected.

At stake is the very heart and soul of our democracy. Make sure your voice is heard loud and clear in future voting booths -- by voicing it loud and clear on Saturday! Hope to see you there!

This critical survey of electronic voting reports: “There is no federal agency that has regulatory authority over the elections industry. There are no restrictions on who can own or operate a voting systems company. There are no mandatory federal standards for voting technology, and no federal certification of that technology. Meanwhile, the states are relying on guidelines and a certification process that are essentially controlled by the industry. Footprints of Electoral Fraud: The November 2 Exit Poll Scam

by Michael Keefer

Reveals collusion between National Election Pool and TV networks in late-night falsifying of original exit poll numbers to cover up the late, sudden, and statistically impossible “red shift” surge of tallied votes that reversed Kerry’s lead and swung the election to Bush.

Statistical Studies Indicating Vote Fraud

The Freeman study found voting tallies deviating from exit polls in Bush’s favor across 11 states, with most pronounced “red shift” in battleground states without paper audit trails

Jonathan Simon examined exit poll anomalies defying probability across all states, noting that in 12 swing states the average shift to Bush was 5%, twice the rate of exit poll disparity in noncritical states.

The Dopp study of Florida vote patterns found the Bush vote skewed an average +128% above the statistically expected count and the Kerry vote depressed -21% throughout the state among counties using optical scan voting machines.

Computer security expert demonstrates how ridiculously easy it is to hack the vote on a Diebold central tabulator. Herrin provides downloadable Diebold GEMS software and a step-by-step screenshot tutorial showing how anyone with a Windows computer and elemental knowledge of a simple spreadsheet can redo the numbers for an entire county in one undetectable maneuver.

Votergate 2004: We Don’t Need Paper to Prove Fraud

by Sheldon Drobny, CPA, auditor, venture capitalist and co-founder of Air America Radio

As an auditor experienced in uncovering complex financial corruption, Drobny says “statisticians can show with great credibility the probability of manipulation within the computer programs used for counting the ballots. They do this kind of work all the time to uncover fraud based upon computer manipulation in commercial and corporate activities. And these types of expert analyses are admissible in a court of law.” Drobny proposes a large-scale, rapid and well-funded auditing campaign to demonstrate the fraud behind the 2004 election.

Demonstration Thursday, December 2nd -- Rochester, NY!

MASSIVE PROTEST
against the media blackout of the
STOLEN ELECTION 2004

5:45pm
Thursday, December 2nd
Gather at Hall of Justice, Exchange Street
March to Democrat and Chronicle

Several Rochester residents who witnessed electoral fraud in Ohio and Florida have stepped forward to testify at the demonstration this Thursday. Did you see something? Do you know of someone who lives in this area who did see something?

Please contact the Metro Justice office at 325-2560.

We have to get the word out. Activist organizations all around the country are shining a spotlight on this issue. We can't stand idly by while the D&C sits on this story.

The Democrat and Chronicle totally blew the weapons of mass destruction story
in the run up to the invasion of Iraq. Now it is failing to cover widespread
electoral fraud in the 2004 election.

Where is the coverage of electoral fraud hearings in Ohio? Where are the
first person narratives from Florida about touchscreen ballots that default
to Bush? Where are the stories about the diverted voting machines and long
lines at polling places in black neighborhoods in Ohio? Where are the
interviews with experts who can show how electronic voting tabulators can be
hacked? Where is the feature article about Louise Slaughter's request to the GAO to investigate the election?

IT IS TIME FOR THE DEMOCRAT AND CHRONICLE TO DO ITS JOB!

See you in the streets,

-Jon Greenbaum, Metro Justice Organizer

Jesse Jackson Demands a Recount, Blasts Ohio Election Officials

Jesse Jackson demands Ohio presidential recount, blasts GOP election officials, and says Kerry supports the process

by Bob Fitrakis & Harvey Wasserman

November 29, 2004

COLUMBUS--Preaching to a packed, wildly cheering central Ohio citizen congregation, Rev. Jesse Jackson blasted the presidential election back into the national headlines Sunday. Jackson said new findings cast serious doubt on the idea that George W. Bush beat John Kerry in Ohio November 2. A GOP "pattern of intentionality" was behind a suspect outcome, he said. At stake is "the integrity of the vote" for which "too many have died." "We can live with losing an election," he said. "We cannot live with fraud and stealing."

Jackson is the first major national figure to come here challenging the idea that Ohio has given George W. Bush a second term in the White House. Jackson emphasized that the vote "has not yet been certified" and demanded the removal of Ohio Secretary of State Kenneth Blackwell from supervising the recount, which Jackson termed a case of "the fox guarding the chicken house." Blackwell co-chaired the Bush-Cheney campaign in Ohio and has been widely criticized for a series of partisan decisions that have thus far indicated Bush carried the state. Exit polls by Zogby and CNN showed Ohio going for Kerry with 53% and 51% respectively, which would win him presidency in the Electoral College.

Blackwell says a complex series of rules allows him to limit a recount to just a few days. He says he may certify the Ohio vote between December 3d and 6th, with any recount due to be completed December 13, when Ohio's electors are scheduled to meet.

Jackson has demanded Blackwell recuse himself, saying "the owner of the team can't also be the referee." A broad-based legal team--now including Jackson's PUSH/Rainbow Coalition as Plaintiff--it preparing to file an election challenge asking the election results be overturned. Jackson says computer forensic experts must be given full access to electronic voting machines that have provided no paper trail, but which could be electronically analyzed from within. Jackson said he has spoken with Democratic candidate John Kerry, who indicated his support for the recount process.

New findings indicate that Kerry's margins in 37 (of 88) Ohio counties are suspiciously low when compared to those garnered by Judge Ellen Connally, an unsuccessful Democratic Supreme Court candidate. The calculations focus on standardized county-wide ratios between bottom-of-the-ticket tallies won by Judge Connally versus those won by Kerry in heavily Republican, rural counties. According to a wide range of experts, there appears to be a systematic removals of Kerry votes by hackers who overlooked the Connally votes, which now clearly infers something went wrong. "It's simply not credible that a vastly underfunded African-American female candidate at the bottom of the ticket could outpoll John Kerry in Butler County," said Cliff Arneback, a lead attorney for the challenging legal team. Jackson said the situation "does not pass the smell test."

Before some 500 supporters, Jackson preached a litany of doubt surrounding the Ohio outcome, prompting at least 50 congregants to file affidavits documenting their own experiences trying to vote November 2. Several hundred such documents have been filed at a series of hearings in Columbus, Cincinnati, and Cleveland.

According to the sworn testimony, a systematic denial of voting machines to inner city precincts resulted in waits of three, five and even eleven hours for thousands of voters, many of whom left in frustration without casting their ballots. Charges of intimidation, misinformation, faulty registration lists and denial of provisional ballots are listed. So are serious questions about the integrity of touch screen machines, many of which were widely reported to have turned Kerry votes into Bush votes. In Warren County, Homeland Security was inexplicably invoked to bar independent observers and the media, leaving the vote count under control of Republicans. In the Franklin County precinct of Gahanna, 4258 votes were registered for Bush where only 628 people voted. In another county, a GOP election official took voting results to his private home for final, unsupervised reporting.

"We need federal supervision of federal elections," said Jackson. "Right now we have 50 separate but unequal ways to vote. There can be no safe harbor for a flawed process that leaves people disenfranchised.

"You can't have public elections on privately-owned machines, especially where one of the owners has vowed to deliver the state for George Bush," Jackson added, referring to Wally O'Dell, a major Bush supporter and CEO of Diebold, a leading Ohio-based supplier of electronic voting machines and voting software.

"You can hack these machines," Jackson said. "The playing field is uneven. These numbers will not go away. We as Americans should not be begging a Secretary of State for a fair vote count. We cannot be the home of the thief and the land of the slave."

"This is not about John Kerry versus George Bush," said Jackson. "This is about Medgar Evers and Fannie Lou Hamer and Viola Liuzzo. About Goodman, Cheney and Schwerner, and twenty-seven years in prison for Nelson Mandela," he said, referring to heroes of the movements for equal rights. "It's about a will to dignity. It's not too much to ask for our vote to count."

Bush's Margin Reduced by 1070 Votes as Result of Montgomery County Tally

http://www.daytondailynews.com/localnews/
content/localnews/daily/1123votecount.html

Board of Elections conducts official count from Nov. 2

By Jim Bebbington Dayton Daily News

DAYTON Sen. John Kerry extended his winning margin slightly inMontgomery County in official results Monday at the Montgomery County Boardof Elections.Board staff on Monday conducted a full, official count of the MontgomeryCounty votes from Nov. 2.The results showed Kerry's margin in Montgomery County grew by 1,070 votes— to 4,616 — over President Bush. The official count did not change the ultimate result of any issues on the ballot, according to board Director Chris Heizer.
The official results are expected to be adopted at the meeting of the boardof elections today. The official count included 7,375 provisional ballots that were cast Nov. 2 but set aside until board staff could check the voter's registration orresidency.
Overall, there were 9,257 provisional ballots cast in Montgomery County, and 1,882 were ruled invalid.Of the 9,257 provisionals, 11.5 percent were ruled invalid because thevoter was not registered, and 8 percent were ruled invalid because thevoter was in the wrong precinct, elections officials said.
Democrats had sought before the election to have Ohio count all votes byregistered voters regardless of whether the voter was in the correctprecinct. But Ohio Secretary of State J. Kenneth Blackwell prevailed in hisinterpretation of Ohio law that requires voters to vote only in their homeprecinct. The official count Monday also helped erase an unusually high number ofso-called undercounted presidential votes in several Montgomery Countyprecincts, including Washington Twp. X and Kettering 3-A, where more than25 percent of the ballots initially registered no vote for president.

Officials said electrical service to three of nine vote-counting machineswas interrupted election night when a fuse blew, then backup batteries died. The precincts that were being counted when the power died were recounted, but the interruption also affected results that were being transmitted tothe central computer.Board staff did not know those were lost until media accounts found thehigh discrepancies, Heizer said.In the official count Monday, Washington X and Kettering 3-A hadundercounts about 2 percent each.
The error meant 186 votes for Bush and 106 votes for Kerry were not countedbetween the two precincts.
>br>Boards of elections across the state have until Dec. 1 to complete their official count of the Nov. 2 election results.

Fight for Democracy Rally

Saturday, December 4, 2004
1:00 - 3:00 p.m.
Ohio Statehouse
Featured Speaker-Journalist Greg Palast

Fact:
Thousands of Ohio citizens had difficulty voting on
November 2nd.

Despite thousands of complaints, a planned recount,
statewide public hearings,
several lawsuits, a Congressional investigation and the outcry of voters rights groups, this fact has been dismissed or underreported by the mainstream media. Even Secretary of State, Kenneth Blackwell, indicated the Ohio election was a huge success, saying, "We came through with flying colors."
Washington Times, 11/04/04

We need thousands of people to attend our
"Fight for Democracy Rally"
to draw attention to voter issues AND to
support the Congressional probe of allegations of irregularities in the November 2nd presidential vote.

Please plan to attend and bring your friends!

America’s election system is badly flawed. So flawed, that a Cal Tech/MIT study of the 2000 Election discovered that as many as one in 18 citizens was disenfranchised due to procedural and/or technological anomalies. The 2004 election was no different! All citizens must have equal access to voting and the electoral process in order to ensure our democracy!

"There's just a lot of allegations of vote fraud that placed their election, the validity of their elections, in doubt," Bush said. "The international community is watching very carefully. Ohio Republican Party Chairman Robert T. Subject: The Ohio Recount is moving forward!

PLEASE FORWARD THIS MESSAGE!

Dear Friends,

The Ohio Recount is moving forward!

Here are updates on:

1. Volunteering opportunities
2. Our financial situation
3. A timetable of what's to come and what's already happened

=========================

1. Mobilizing Thousands of Volunteers

We'll be mobilizing thousands of volunteers
in December to observe the hand recount
in all 88 counties in Ohio. A recount without
Cobb-Badnarik volunteer observers providing
truly independent oversight of the process
will not provide meaningful feedback on the
problems or do much to improve public
confidence in the integrity of the voting
system. Please join us by completing our
volunteer form at http://www.votecobb.org

2. Giving Thanks for Democracy

Thanks to the generosity of thousands of
small donors coast-to-coast, the
Green Party's Cobb/LaMarche campaign
has already raised $250,000 toward the
costs of the recount. $113,600 has gone
out the door already to pay the State of
Ohio's recount filing fee.

We have been raising the money in phases,
since we didn't want to raise more until we
were certain the minimum needed was
raised. Now that we have completed our
grassroots operation planning, we estimate
that the recount will cost an additional
$88,000 for training and staffing costs
(approximately $1000 needed in each of
the 88 Ohio counties).

If you value democracy, and the attention
that this recount will bring to the many ways
that voting processes need to be improved
in this country, then please make a donation
today by going to http://www.votecobb.org

3. Ohio Recount Timeline

To keep you in the loop, here are past and
future dates related to the recount process:

11/10 Green Party Presidential candidate
David Cobb announces on KPFK
radio that he and Michael Badnarik
of the Libertarian Party are considering
filing for a recount in Ohio. Hundreds
of emails pour in, encouraging the
Green Party to take a stand.

11/11 The Cobb/LaMarche campaign
confirms their intention to file for a
recount in a public statement and
press release, and requests
donations to pay for the effort.

11/15 Common Cause, the National Voting
Rights Institute, Demos, the Fannie
Lou Hamer Project and People for the
American Way Foundation issue a
joint statement in support of the
Cobb-Badnarik demand for an
Ohio recount.

11/15 The Cobb/LaMarche campaign meets
initial fundraising goal of $150,000
(including the $113,600 recount fee
needed to file).

11/17 Attorneys on behalf of David Cobb
and Michael Badnarik deliver letters to
each Ohio county election director,
asking them to prepare for the recount.

11/18 Congressman Dennis Kucinich
publicly endorses recount efforts.

11/19 Cobb-Badnarik representatives
deliver bond to guarantee $113,600
recount fee to each of the 88 Ohio
county election directors.

11/20 Two Cobb/LaMarche campaign staff
relocate to Columbus, Ohio to work
with volunteers on the ground.

11/21 Cobb/LaMarche team meets second
fundraising goal, reaching $250,000
in eleven days.

11/21 Cobb-Badnarik lawyers file a request
for an expedited recount in federal
district court in Toledo, Ohio, so that
a "meaningful recount" can take place
prior to the December 7th "safe harbor"
certification and December 13th
meeting of Ohio presidential electors

11/22 The Delaware County, Ohio Board of
Elections seeks a temporary restraining
order to block Green and Libertarian
presidential candidates from forcing a
recount of the Nov. 2 election results
prior to December 1st. Their request
is granted by the judge.

11/22 Federal district court judge denies
Cobb-Badnarik request to expedite
recount, saying that Cobb and Badnarik
do not face "irreparable harm" if the
recount doesn't take place until after
the December 7 date to certify
presidential electors, since they will
not have any electors anyway.

11/24 Over 1,000 volunteers have already
signed up to help on website at
http://www.votecobb.org but
many
more still needed.

11/28 The Reverend Jesse Jackson to hold
rally in support of recount and other
efforts to investigate and litigate voting
irregularities in Ohio.

12/01 Date by which most Ohio counties will
have certified their initial vote totals.

12/04 Citizen electoral reform groups organize
a rally to "Investigate all 88."

12/06 Date that Ohio Secretary of State Kenneth
Blackwell currently (as of 11/25) says he
will finally certify the vote. Then, as detailed
in Ohio Election law procedures, Cobb and
Badnarik will formally request a recount
and Secretary Blackwell will notify other
candidates of their right to have observers
at the recount. Under law, other candidates
must have 5 days of notice before the
recount can start.

12/07 The "safe harbor" date by which presidential
electors in all 50 states must be
conclusively determined.

12/11 Earliest possible start date for the Ohio
recount, based on recent judicial ruling and
Blackwell's current timeline for
certification of the state vote.

12/13 Date by which, pursuant to Constitutional
mandates, Electoral College electors must
meet to cast their votes. This applies to
Ohio and all other states.

Again, we thank you sincerely for your interest
and participation in the Ohio Recount. With your
help, democracy will be served.

Please be sure to volunteer, donate, and circulate
this email to your friends and family!

Sincerely,

San Francisco, CA 94111

We insist that Senator Boxer and all of our representatives take immediate
action to safeguard the elections process. A small contingent of us have
been invited to talk with Boxers aide, which we very much appreciate! We

We demand draft legislation to ensure:

- Minimum standards in the voting procedure throughout the US.

- That all "spoiled" ballots and provisional ballots are counted by hand
and fairly.
- To uphold and enforce the Voting Rights Act to prevent the continued

ensure fair and accountable elections.

of the tens of thousands of reported complaints regarding the 2004 election.

order Ohio Secretary of State Ken Blackwell to impose uniform standards for
counting provisional votes on all 88 counties.

11/27 Letter to Barbara Boxer by M.T. Karthik of Pacifica Radio/KPFK:

--
Senator Boxer:

Let me begin by saying I voted for you.

And that you may now be the only person that we on the Progressive Left can
approach, because you are in many ways a part of Power and the Ruling Class
in the United States and you are a well-respected member of one of the
Major Parties. We beseech you to ignore Republicans, Democrats and
so-called Progressives who have conceded this election as accomplished
fairly and to independently look into the matter.

Please, Senator Boxer, take up the call for Investigation of the Election
of 2004. Do it now. Before the Electoral College votes and before the
Inauguration of the President.

At this moment - as in 2000 - colleagues of yours in the House are prepared
to contest and investigate the election for fraud. One Senator willing to
ask is all they need to achieve such a request.

Only one single Senator who is politically safe, who has the support of a
Progressive community, and who has the courage of conviction to stand up
and say simply that decisions regarding how we vote and for whom are being
made too quickly, and as a result carelessly, and perhaps erroneously;

that our democratic processes are being rushed and hurried by the
Republicans led by Bush's Karl Rove [called the "architect" of the
re-election by Cheney] and

that democracy is suffering terribly if not critically.

As a woman and a relatively progressive Democrat, you are SAFE in your
district and have recently won re-election easily. People here support you
for your ideas and values.
You are in a SAFE state among people who share many of your beliefs.

After hearing four weeks of testimony from key states [especially Ohio] and
after reading horrifying stories from around the country as to what
happened on Tuesday, November 2, I and many of your other constituents
believe that the results of the 2004 election are significantly riddled
with problems, many of which circumstantially point to the STRONG
possibility of FRAUD and vote fixing.

Senator Boxer, changing the outcome of the election is NOT our interest in
asking this of you.

The desperate and fundamental need for a fair elections process and real
democracy DEMANDS a slower, measured, piece-by-piece investigation
conducted by Congress of the Election of 2004 and in particular of the
votes cast via electronic voting machines.

The falsely named Help America Vote Act served only to rush US counties and
states into purchasing machines that have become Black Holes for American
Votes.

California's Secretary of State Kevin Shelley was admired by people across
the State for standing up to the manufacturers complicit in rushing these
devices past proper standards and though now he is being attacked within
the system by the powers that be, it is clear he has TREMENDOUS public
support for his forward-looking and progressive actions on e-voting over
the past year and a half.

Senator Boxer, you will be greeted by a flood of support from the
grassroots level if you take this on. You could revolutionize the argument.

By setting an aggressive calendar for hearings and for public and private
input, Secretary of State Shelley was able to decertify machines and to put
out a long, detailed list of 23 conditions for the use of other such
machines to make them safer and more accurate for Californians. He said
when doing this that cheating wasn't going to happen on his watch.

He then testified before the Election Assistance Commission and at both the
Democratic and Republican Conventions, that other states should earnestly
learn from California's experience and institutionalize protections ... but
it was too little, too late.

Other states and indeed Bush's White House and the GOP-controlled Congress
diminished the significance of Secretary of State Shelley's remarkably hard
work.

As our Senator won't you chastise them for what they did to our Secretary
of State? Won't you stop their stampeding toward re-election for long
enough to examine the facts and the data? Won't you please tell the rest of
the country that Californians were very relieved to have had a Secretary of
State who cared enough to demand protections against problems suffered in
other parts of the country?

Please, Senator Boxer, look deep into the future of this country, summon
the courage and do what you do so well.

Stand with your colleagues in the House who believe a Congressional
Investigation into the Election of 2004 is an absolute necessity before the
U.S.A. can pass one more law or engage in one more battle.

Only one Senator is required ... it would make us all proud if you were first.

Respectfully,

M.T. Karthik

Fight for Democracy Rally

Saturday, December 4, 2004

1:00 - 3:00 p.m.

Ohio Statehouse

Featured Speaker-Journalist Greg Palast

Fact:
Thousands of Ohio citizens had difficulty voting on
November 2nd.

Despite thousands of complaints, a planned recount,
statewide public hearings,
several lawsuits, a Congressional investigation and the outcry of voters rights groups, this fact has been dismissed or underreported by the mainstream media. Even Secretary of State, Kenneth Blackwell, indicated the Ohio election was a huge success, saying, "We came through with flying colors."
Washington Times, 11/04/04

We need thousands of people to attend our

"Fight for Democracy Rally"

to draw attention to voter issues AND to
support the Congressional probe of allegations of irregularities in the November 2nd presidential vote.

Please plan to attend and bring your friends!

America's election system is badly flawed.

Protest to Demand Recount, Delaware, OH, Mon. Nov. 29thth, 11:00 a.m.

For Immediate Release

Contact: Paddy Shaffer (paddy@columbus.rr.com)((614) 761-0621)

WHY DOES THE DELAWARE COUNTY BOARD OF ELECTIONS FEAR THE TRUTH ??

What: Peaceful, Patriotic Protest - Demanding a Vote Recount inDelaware County.

Where: Delaware County Courthouse, 91 North Sandusky Street, Delaware, Ohio USA 43015-1703

Directions: From Columbus, go north on State Route 23. Get off onSandusky Street exit and go north into town. It is approx. 1½milesdown the road. You will pass Rt. 36 and Rt. 37. It will be in theblock following Rt. 37.

When: Monday November 29th 2004 at 11:00 a.m.

What to bring: Appropriate clothing to be outside for awhile, signs, bullhorns for sound amplification, drums, and whatever else you feelwill help you express your feelings.

Why: Paddy Shaffer: "It is time for Delaware County to begin to recount the results of the November 2004 election. They do not plan to do it. We need to demand that the recount happens, and soon in Delaware County. If our vote in Delaware is not recounted, other counties are looking to stop the recount also. The election results could still change. Here is the story… Federal Judge James G. Carr in Toledo ruled that Ohio law gives the candidates the right to a recount, but the judge says it can wait. Delaware County Common Pleas Judge W. Duncan Whitney granted a temporary restraining order on Nov. 23, 2004 to block a recount to the Nov. 2, 2004 presidential election. They are seekingto make this a permanent restraining order. If they succeed, we will be prevented from knowing what the true vote is and what reallyhappened on election day. Official results of the election are to be certified by Dec. 6,2004. Electors for the Electoral College are to be certified by Dec.7. The recount needs to begin NOW, so it is finished on time. Thepermanent restraining order Delaware County seeks will prevent arecount from ever happening for the 2004 election, even if the stateorders it because the final count is close. The Delaware County Board of Elections is using CountyProsecutor David Yost as their legal advisor. He was quoted in theColumbus Dispatch saying, "to ask taxpayers to fund someone's political hobbyhorse when there is no possible chance of a different outcome seems to be an utter waste. There are better uses for that money in Delaware County and, I suspect, in other places around the state". He didn't know what it would cost, but said it would be substantial. To understand what happened in the Florida 2000 election, I recommend the movie titled "Unprecedented". To movequickly on the election results is very important. If the Florida votes had been counted quicker, Gore just might be our president today. The Bush Administration has requested that the UkrainianGovernment not certify the results of their very recent disputed presidential election. They are asking that they wait until athorough investigation of broad irregularities and voter suppressionis resolved and the true count determined. Don't we deserve the same respect for the integrity of our vote in Ohio (and some of the other states also) that the United States is demanding of Ukraine. Two Public Hearings were held in Franklin County onNov. 13 and 15 on the widespread voter suppression and vote irregularities in Ohio. Over 500 attended, and sworn affidavits were taken by approximately 200 concerned voters. Stories are still being collected on the problems of the Nov. 2 election. Check out this site for more information on the Public Hearings…http://www.freepress.org/departments/display/19/2004/886 Questions to Ask: 1. If David Yost is so confident of their procedures, why doesn't he want it verified? Particularly when it is such a close election, with the whole world watching – we deserve better.2. "Political Hobbyhorse". This comment is insulting to thousands ofOhioans that are concerned with and acting to protect our democratic elections.3. David Yost thinks there are better uses for the money than a recount. What could be a better use of the money than to get the results counted and made public of who, and for what, the people ofDelaware voted . Maybe these results won't change, but what if they do? If they claim poverty, what would they do if the state had an automatic recount, which we are very close to? So besides thecandidates asking for the recount, when the certified results are turned in, we may be close enough for an automatic recount by thestate. If Delaware County gets the permanent injunction, they will not recount whether the candidate or the state wants it.The Libertarian and Green Parties paid the amount of $113,600.00 for the recount. The Democratic Party and many other voting rights organizations endorsed this. This is the amount required for a recount. Yost should follow through and do what is required of his county, Delaware County. The Delaware County Board of Elections should be working in a nonpartisan manner. Does Delaware County have something to hide? If not, why do they fear the recount? Lets have Delaware County come clean on the Election so we don't become the laughing stock of the nation, like Florida did in the 2000 election. Does Delaware County want to be the brunt of Letterman and Leno's jokes for years to come? A recount is a good idea in an election with problems, and that is what has happened with this 2004 Presidential Election. What else can you do? Letters to the Editor, to Congress, to the Senate, contact the media, talk to neighbors, talk to and write your elected officials. Get Delaware to count the votes NOW! Donate to blackbox.org to help with the election audit. Share the below sites with others. Invite others to join us Monday. Spread the word. The election issues need resolved NOW, not in four years. If you have questions contact Paddy Shaffer at paddy@columbus.rr.com or at (614) 761-0621. "

News Release from Green Party

(1) PRESS RELEASE FROM THE COBB CAMPAIGN:

NEWS RELEASE
For immediate release: November 26, 2004
Contact: Blair Bobier, Media Director

JESSE JACKSON TO VISIT OHIO SUNDAY AND LEND SUPPORT TO
GREEN PARTY RECOUNT DEMAND

Green Party presidential candidate David Cobb's demand
for a recount of the Ohio presidential vote will gain
a significant boost this Sunday, when Jesse Jackson
visits Columbus, Ohio to publicly announce his support
for the recount and other challenges to the
controversial Ohio vote.

Jackson will be speaking on Sunday at the Mt. Herman
Baptist Church, 2283 Sunbury Rd., at 3:30 p.m., in
Columbus.

"Voter suppression and intimidation is a civil rights
issue. Jesse Jackson is the perfect person to bring
these concerns to a wider audience and we welcome his
participation," said David Cobb, whose campaign has
been leading the charge for the Ohio recount. Cobb
has been joined in the recount demand by Libertarian
candidate Michael Badnarik.

"We need to investigate, coordinate, litigate, recount
and recuse," said Jackson, referring to the recount
and other efforts and lawsuits challenging the
legitimacy of the Ohio vote.

Jackson's recusal reference indicated his support for
Cobb and Badnarik's demand that Ohio Secretary of
State Kenneth Blackwell, a co-chair of the Bush
campaign, recuse himself from the vote-counting
process.

"You don't have an owner of a team be the umpire of
the seventh game of the World Series," Jackson said.

Jackson joins Ohio Congressman and former presidential
candidate Dennis Kucinich and a growing list of
individuals and organizations calling for a recount.

The Cobb-LaMarche campaign is now in the process of
recruiting volunteers and raising funds for monitoring
the actual recount process which is expected to take
place in early December. Volunteers and donors should
visit the campaign website, http://www.votecobb.org/,
for more information.

(2) UPDATE ON THE OHIO RECOUNT FROM THE COBB CAMPAIGN:

Dear Friends,

The Ohio Recount is moving forward!

Here are updates on:

1. Volunteering opportunities
2. Our financial situation
3. A timetable of what's to come and what's already
happened

=========================

1. Mobilizing Thousands of Volunteers

We'll be mobilizing thousands of volunteers
in December to observe the hand recount
in all 88 counties in Ohio. A recount without
Cobb-Badnarik volunteer observers providing
truly independent oversight of the process
will not provide meaningful feedback on the
problems or do much to improve public
confidence in the integrity of the voting
system. Please join us by completing our
volunteer form at http://www.votecobb.org

2. Giving Thanks for Democracy

Thanks to the generosity of thousands of
small donors coast-to-coast, the
Green Party's Cobb/LaMarche campaign
has already raised $250,000 toward the
costs of the recount. $113,600 has gone
out the door already to pay the State of
Ohio's recount filing fee.

We have been raising the money in phases,
since we didn't want to raise more until we
were certain the minimum needed was
raised. Now that we have completed our
grassroots operation planning, we estimate
that the recount will cost an additional
$88,000 for training and staffing costs
(approximately $1000 needed in each of
the 88 Ohio counties).

If you value democracy, and the attention
that this recount will bring to the many ways
that voting processes need to be improved
in this country, then please make a donation
today by going to http://www.votecobb.org

3. Ohio Recount Timeline

To keep you in the loop, here are past and
future dates related to the recount process:

11/10 Green Party Presidential candidate
David Cobb announces on KPFK
radio that he and Michael Badnarik
of the Libertarian Party are considering
filing for a recount in Ohio. Hundreds
of emails pour in, encouraging the
Green Party to take a stand.

11/11 The Cobb/LaMarche campaign
confirms their intention to file for a
recount in a public statement and
press release, and requests
donations to pay for the effort.

11/15 Common Cause, the National Voting
Rights Institute, Demos, the Fannie
Lou Hamer Project and People for the
American Way Foundation issue a
joint statement in support of the
Cobb-Badnarik demand for an
Ohio recount.

11/15 The Cobb/LaMarche campaign meets
initial fundraising goal of $150,000
(including the $113,600 recount fee
needed to file).

11/17 Attorneys on behalf of David Cobb
and Michael Badnarik deliver letters to
each Ohio county election director,
asking them to prepare for the recount.

11/18 Congressman Dennis Kucinich
publicly endorses recount efforts.

11/19 Cobb-Badnarik representatives
deliver bond to guarantee $113,600
recount fee to each of the 88 Ohio
county election directors.

11/20 Two Cobb/LaMarche campaign staff
relocate to Columbus, Ohio to work
with volunteers on the ground.

11/21 Cobb/LaMarche team meets second
fundraising goal, reaching $250,000
in eleven days.

11/21 Cobb-Badnarik lawyers file a request
for an expedited recount in federal
district court in Toledo, Ohio, so that
a "meaningful recount" can take place
prior to the December 7th "safe harbor"
certification and December 13th
meeting of Ohio presidential electors

11/22 The Delaware County, Ohio Board of
Elections seeks a temporary restraining
order to block Green and Libertarian
presidential candidates from forcing a
recount of the Nov. 2 election results
prior to December 1st. Their request
is granted by the judge.

11/22 Federal district court judge denies
Cobb-Badnarik request to expedite
recount, saying that Cobb and Badnarik
do not face "irreparable harm" if the
recount doesn't take place until after
the December 7 date to certify
presidential electors, since they will
not have any electors anyway.

11/24 Over 1,000 volunteers have already
signed up to help on website at
http://www.votecobb.org but many
more still needed.

11/28 The Reverend Jesse Jackson to hold
rally in support of recount and other
efforts to investigate and litigate voting
irregularities in Ohio.

12/01 Date by which most Ohio counties will
have certified their initial vote totals.

12/04 Citizen electoral reform groups organize
a rally to "Investigate all 88."

12/06 Date that Ohio Secretary of State Kenneth
Blackwell currently (as of 11/25) says he
will finally certify the vote. Then, as
detailed
in Ohio Election law procedures, Cobb and
Badnarik will formally request a recount
and Secretary Blackwell will notify other
candidates of their right to have observers
at the recount. Under law, other candidates

must have 5 days of notice before the
recount can start.

12/07 The "safe harbor" date by which presidential
electors in all 50 states must be
conclusively determined.

12/11 Earliest possible start date for the Ohio
recount, based on recent judicial ruling and

Blackwell's current timeline for
certification of the state vote.

12/13 Date by which, pursuant to Constitutional
mandates, Electoral College electors must
meet to cast their votes. This applies to
Ohio and all other states.

Again, we thank you sincerely for your interest
and participation in the Ohio Recount. With your
help, democracy will be served.

Please be sure to volunteer, donate, and circulate
this email to your friends and family!

Sincerely,

Lynne Serpe
